II. Generalities and validity of the GTC

Prior to placing an order, the customer acknowledges having read and understood the general terms and conditions of sale set out on this page and expressly accepts them without reservation. These general terms and conditions of sale govern the contractual relationship between WAGNER BOIS and its customer. They shall prevail over any other conditions appearing in any other document, except in the event of prior, express and written derogation by WAGNER BOIS.

WAGNER BOIS reserves the right to modify these terms and conditions at any time without prior notice. The conditions applicable will be those in force on the site at the time the order is validated.

III. The customer

The customer declares that he/she is a natural person of legal age, with the legal capacity to accept these terms and conditions of sale and to place an order on the site. He/she may not make purchases on the site in connection with his/her professional activity or for the purpose of reselling the products ordered. Orders placed must be limited to strictly personal use.

IV. Products on the site

The products displayed on the site are offered within the limits of stocks available from our stores or suppliers. As a result, a product may be unavailable for a limited time while our stock is replenished.

Each product is accompanied by a presentation drawn up by WAGNER BOIS as objectively as possible in order to satisfy the customer’s need for information.

Product images are prepared in such a way as to be as faithful as possible to the actual products, but do not guarantee color accuracy due to the numerous screen and internet browser options used by the customer.

Despite the great care taken in drafting product descriptions, errors may occasionally appear on the site. The customer acknowledges and accepts this.

V. Product warranty

All products sold on the wagnerbois.com website are covered by the manufacturer’s warranty. Any warranty is excluded in the event of misuse or negligence on the part of the customer.

As WAGNER BOIS is not the manufacturer of the products presented on the site, it cannot be held responsible for hidden defects resulting from a defect in the material or its manufacture, or from defective products rendering them unfit for use.

In the event of a product appearing to be defective, any claim, request for exchange or refund must be addressed to WAGNER BOIS within a maximum of 14 days from the date of delivery.

VI. Product prices

Prices are quoted in euros and include the applicable VAT.

The price indicated on the product sheets does not include transport.

The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT. This price includes the price of the products, handling and packaging costs, as well as transport costs.

WAGNER BOIS reserves the right to adjust prices without prior notice to the customer. The prices shown on the website at the time a product is ordered are the only prices applicable to the purchaser, subject to product availability.

VII. Orders

Prior to validating an order, the customer will have read the essential characteristics of the products and their prices. The customer is the sole judge of the compatibility of the products ordered and of his or her ability to use them.

Validation of an order constitutes a digital signature and acceptance of the operations carried out. WAGNER BOIS will confirm the order to the email address provided by the customer.

Nevertheless, WAGNER BOIS reserves the right to cancel any order from a customer with whom it has had a previous dispute relating to the payment of an order, or from any customer whose information on the website appears to be inconsistent.

VIII. Product availability

As a general rule, orders are processed by WAGNER BOIS after validation of payment and receipt of payment by WAGNER BOIS if the customer has chosen to pay by bank transfer.

Availability times are confirmed by WAGNER BOIS upon validation of the order. Availability times are subject to change at the discretion of the supplier and/or manufacturer.

In the event of unavailability of products from our suppliers:

Definitive unavailability: WAGNER BOIS undertakes to offer the customer replacement items or to reimburse him for the missing items, without delay and within 30 days at the latest.

Temporary unavailability: WAGNER BOIS informs the customer when the product will be available again. The customer then has the option of maintaining the order within the new timeframe or cancelling it. In the latter case, WAGNER BOIS undertakes to reimburse the missing items without delay and within 30 days at the latest.

IX. Payments

Delivery is only made against prepayment. Payment against invoice is not accepted.

Payment is in Euro and can be made :

By bank transfer
By credit card

In the absence of specific stipulations, payment must be made within 7 days of order registration.

X. Late payment

If, after extension of the payment deadline, the customer has still not paid what he owes, WAGNER BOIS may claim damages as stipulated in the Belgian Civil Code on the law of obligations. In particular, WAGNER BOIS has the right to assign outstanding debts to external collection companies.

XI. Deliveries

In order to guarantee adjustments adapted to the customer’s size/morphology, orders are shipped by our private carriers. WAGNER BOIS will contact the customer to make an appointment for home delivery.

Orders are delivered to the address provided by the customer at the time of ordering. To ensure that delivery times are respected, the customer must ensure that the address provided is accurate and complete.

The delivery times indicated on the site are indicative.

It may happen that a product is located in a stock other than the one from which the parcel will be sent. In this case, the final delivery time for the parcel will include the time taken to return the product to the main stock and the normal delivery time.

WAGNER BOIS cannot be held responsible for any delay in delivery once the parcel(s) have left our warehouse.

Delivery charges are shown on the order confirmation page.

For reasons of availability, an order may be delivered to the customer in several shipments. In this case, the customer will not be charged for the shipping costs of the second parcel.

XII. Receipt of delivery

Orders are delivered to the customer from Monday to Friday according to postal delivery times.

Whatever the place of delivery, in the absence of the addressee, a delivery notice is left at the delivery address. The recipient then has 7 days to collect it from the post office. After this period, the parcel is returned to WAGNER BOIS.

XIII. Delivery problems

In the event of a parcel arriving damaged – i.e. open, torn or damaged – the customer must immediately report this to the letter carrier or delivery person, and refuse the parcel if necessary. A new parcel will then be returned to the customer as soon as possible, free of delivery charges and subject to availability.

If a parcel does not contain the correct product, the customer must contact WAGNER BOIS on the day of delivery to report the error in the order by email.

After this time, the customer will no longer be able to make a complaint about the order and will release WAGNER BOIS from any liability to modify the order.

If a parcel does not contain the correct item, it is the customer’s responsibility to return the parcel with the prior agreement of WAGNER BOIS. Delivery costs are borne by WAGNER BOIS.

XIV. Right of cancellation

If the customer wishes to refuse a parcel for a reason other than those mentioned in pt. 13, he must justify this in writing to WAGNER BOIS within 3 days of delivery. If WAGNER BOIS agrees to take back the products, the customer is responsible for the shipping costs.

Returned products must be new and in their original packaging, unworn, unwashed, unmodified and undamaged, with no trace of use whatsoever.

In the event of cancellation and return of goods by the customer, WAGNER BOIS will reimburse the customer within thirty days of receipt of the goods the value of these products, less delivery costs.

XV. Disputes

The general terms and conditions of WAGNER BOIS are subject to Belgian law.

WAGNER BOIS cannot be held liable for any damage of any kind, whether material, immaterial or physical, resulting from malfunction or misuse of the products sold on the wagnerbois.com website.

The same applies to product modifications by manufacturers.

The liability of WAGNER BOIS is limited to the amount of the order.

Failing this, the general conditions of sale being governed by Belgian law, only the Belgian courts will have jurisdiction.

XVI. Place of jurisdiction

These general conditions of sale and the contracts based on them are governed by Belgian law. The place of jurisdiction is exclusively 5 ROUTE DE BITCHE 57230 PHILIPPSBOURG, FRANCE or another legal place of jurisdiction according to the choice of WAGNER BOIS.

XVII. Protection of personal data

All personal customer data collected by WAGNER BOIS is required for order processing and invoicing. In order to respect the customer’s privacy, this data will not be passed on to third parties.

Upon written request, the customer has the right to access, modify, rectify or delete data concerning him/her collected by the site.

XVIII. Final provisions

Should one or more of these terms and conditions be wholly or partially ineffective, or should they subsequently become ineffective, the legal validity of the remaining terms and conditions shall remain unaffected.
